Thomas Saporito Date: 07 JUL 2009 Voice: (561) 972-1452 Cell Phone (561) 283-0613 Office Phone Email: Support@SaporitoEnerqyConsultants@.com NRC TO HOLD PUBLIC TELECONFERENCE ABOUT SAFETY AT FPL'S TURKEY POINT NUCLEAR POWER PLANT The NRC has confirmed to Thomas Saporito, president of Saporito Energy Consultants, Inc., (SEC), that the agency has accepted a petition filed by SEC requesting that. the NRC order the Florida Power and Light Company (FPL) to make certain changes at FPL's Turkey Point Nuclear Power Plant (TPN). Specifically, SEC has requested that the NRC (1) issue FPL a civil penalty in the amount of 1-million dollars and (2) that the NRC issue FPL a Confirmatory Order requiring FPL to initiate an independent assessment of FPL's Employee Concerns Program (ECP) and management's implementation of the program and (3) that FPL provide training about its ECP to FPL nuclear workers and to FPL management and (4) that FPL advertise the program to its nuclear workers.
Since his discharge from FPL's TPN facility in 1988, Saporito has maintained to the NRC that a "hostile work environment" exists at the TPN facility and that nuclear workers were afraid to raise nuclear safety concerns to anyone including the NRC. Over the last 20-years, FPL has been found to have illegally discriminated against two of its nuclear workers who raised safety concerns at the TPN facility. According to Saporito, "In reality, many nuclear workers filed retaliation complaints against FPL over the last 20-years;
.however, many of those folks did not have the resources to take FPL to court.", Saporito said. Also, some of the retaliation claims filed against FPL by its nuclear workers with the U.S. Department of Labor are settled before going to court.
FPL is currently engaged in a legal dispute with David Hoffman, who worked at the TPN facility as a senior plant operator. At the time of Hoffman's employment at TPN, he held a NRC license which authorized him to operate the plant's nuclear reactor. Following a significant even in 2006 at one of FPL's substations, about 3-million FPL customers were left in the dark when
several of FPL's power plants shut-down, including the TPN facility. Hoffman was forced to quit his job at FPL because of being pressured to restart one of the TPN nuclear reactors too quickly. Rather than place his NRC license in jeopardy and place the public's health and safety at risk, Hoffman tendered his resignation.
In a more recent event, FPL fired it Licensing Manager at the TPN facility after he authored a report about FPL's ECP that was extremely critical of FPL management. The individual filed a whistleblower action against FPL with the U.S. Department of Labor - OSHA following his discharge from TPN. SEC has learned that this individual has reached a six-figure settlement with FPL over his discharge without reinstatement to his former position at TPN. According to Saporito, "These types of whistleblower settlements may compensate the aggrieved employee but they do little for other FPL nuclear workers' confidence to raise safety concerns without fear of reprisal by FPL management. Instead, FPL should be required to reinstate the aggrieved employee to his former position at FPL so that other nuclear workers can see that the whistleblower system works and that their jobs will be protected if they raise safety concerns." Saporito said.
