PUBLIC MEETING TO DISCUSS THE U.S. NUCLEAR REGULATORY COMMISSIONS REVISED FUEL CYCLE OVERSIGHT PROCESS

Dear Mr. Killar:

This letter confirms our conversation during the public meeting on June 22, 2009, concerning a meeting with the Nuclear Energy Institute and industry representatives. The purpose of the meeting is to further discuss elements of the Revised Fuel Cycle Oversight Process (RFCOP).

The objectives of this meeting are to: (1) discuss the RFCOP with an emphasis on the action matrix and its inputs; (2) discuss the regulatory framework and associated cornerstone definitions; (3) discuss the definition of a licensee performance deficiency; and (4) discuss the performance indicators and the significance determination process for the emergency preparedness and criticality safety cornerstones.

This meeting, which is open to the public, is scheduled for July 28, 2009, from 1:00 p.m. to 5:00 p.m., July 29-30, 2009, from 8:30 a.m. to 5:00 p.m., and will be held at the U.S. Nuclear Regulatory Commission (NRC) Region II Office, Sam Nunn Atlanta Federal Center, 61 Forsyth Street SW, Suite 23T85, Atlanta, Georgia in the Division of Fuel Facility Inspection conference room, 23T140. This will be a Category 2 meeting in which members of the public are invited to participate in this meeting by discussing regulatory issues with the NRC at designated points identified on the agenda, per the NRC policy statement Enhancing Public Participation in NRC Meetings, published in the Federal Register: May 28, 2002 (Volume 67, Number 102, Pages 36920-36924). Copies of the meeting notice and agenda are enclosed.

Interested stakeholders and other members of the public should contact the meeting coordinator Jennifer Foster at (404) 562-4738 or Jose Diaz at (404) 562-4736 by July 24, 2009, indicating their intention to attend. This will ensure that sufficient copies of meeting materials are available. Also, interested members of the public can participate in this meeting via toll-free audio teleconference. Because meetings are sometimes cancelled as a result of unforeseen circumstances, members of the public should contact the meeting coordinator at the number shown above to confirm that the meeting will occur as scheduled.

The U.S. Nuclear Regulatory Commission (NRC) is hosting a meeting open to the public on July 28, 29, and 30, 2009. This meeting is a follow up to an NRC meeting with the Nuclear Energy Institute (NEI) and industry representatives on June 22, 2009, on the RFCOP.
