June 26 2009 Ms. Anne W. Cottingham Associate General Counsel Nuclear Energy Institute 1776 I Street, NW, Suite 400 Washington, DC 20006-3708
SUBJECT:
RESPONSE TO NEI REQUEST TO EXTEND COMMENT PERIOD FOR THE REVISED DRAFT NRC ENFORCEMENT POLICY, SECTION 6.0
Dear Ms. Cottingham:
I am responding to your letter of June 18, 2009, which requested an extension of the public comment period for the revised draft NRC Enforcement Policy Section 6.0, Supplements -
Violation Examples, (74 FR 27, 191) that ends on Wednesday, July 8, 2009.
For the reasons stated in your request, including the need to develop a fully informed view of the example violations and the requisite severity levels, as well as the impact these changes have on the Enforcement Policy, I am informing NEI that we intend to consider comments, as appropriate, from all parties even after the comment period closes. I encourage NEI to provide its comments as soon as practicable and preferably no later than Wednesday, July 22, 2009, so that the staff can complete the action necessary to resolve the comments received and move the process forward to issue the new policy.
I also wanted to inform you that it is my understanding that the Office of New Reactors has held multiple public meetings during which the draft enforcement policy and the examples of violations from the draft supplements were discussed.
If you have any further questions, please contact Mr. Doug Starkey of my staff at 301-415-3456.
Sincerely,
/RA/
Cynthia A. Carpenter, Director Office of Enforcement
