STAFF EVALUATION OF EXEMPTION REQUEST FROM 10 CFR 72.212(a)(2)

AND 10 CFR 72.212(b)(7) REQUIREMENTS AT THE GRAND GULF NUCLEAR STATION (TAC NO. L24296)

Dear Mr. Krupa:

By letter dated December 22, 2008, as supplemented March 20, 2009, Entergy Operations, Inc.

(Entergy) submitted a one-time exemption request from the requirements of 10 CFR 72.212 (a)(2) and (b)(7) for HI-STORM 100 System Model 68 Multi-Purpose Canisters with serial numbers 045, 069, 214, and 215 due to non-compliance with the terms and conditions of the Holtec International Certificate of Compliance - 1014, Amendment No. 2, at the time of cask loading at Grand Gulf Nuclear Station. The U.S. Nuclear Regulatory Commission (NRC) staff has evaluated the proposed exemptions. The enclosed staff evaluation concludes that the requested exemptions are authorized by law and will not endanger life or property or the common defense and security and are otherwise in the public interest. Accordingly, the exemptions are granted and effective immediately. These exemptions do not relieve Entergy of any other regulatory obligations pursuant to either 10 CFR Parts 20 or 72.

The NRC staff evaluated the public health and safety and environmental impacts of the proposed exemptions and determined that granting these exemptions would not result in any significant impacts. For this action, an Environmental Assessment and Finding of No Significant Impact was prepared and submitted to be published in the Federal Register. A copy of the submittal is enclosed.
