BELLEFONTE NUCLEAR PLANT (BLN) UNITS 1&2 - PLANT CONFIGURATION CONTROL DEFICIENCIES By letter dated August 26, 2008, TVA requested the reinstatement of BLN's Construction Permits (CPPR-122 and CPPR-123). In that letter, TVA stated that after the Construction Permits were withdrawn in September 2006, preservation and maintenance activities ceased and some investment recovery activities took place at the Bellefonte site. TVA reinstituted BLN's Quality Assurance Plan on March 16, 2009, after the Construction Permits were reinstated on March 9, 2009. Plant structures, systems or components, as defined by 10 CFR 50, Appendix B, will be entered into the corrective action program and prohibited from being placed into service without evaluation and having been restored or replaced. Nonetheless, in the period of time in which the Construction Permits were withdrawn, the BLN Quality Assurance Plan was terminated and configuration control and physical equipment issues were not, and could not be documented under a qualified plan.

The purpose of this letter is to document the fact that configuration control and physical equipment issues were not documented under a qualified plan for the above mentioned period.

This deficiency was initially reported to the NRC Operations Center on May 14, 2009, as Problem Evaluation Report 170988. Though background information was provided to NRC in TVA's August 26, 2008, letter, this letter provides additional information given the resumption of TVA's reporting responsibilities under 10 CFR 50.55(e).

The enclosure to this letter contains the final report for the subject matter. The attachment to the enclosure provides the list of commitments made in this submittal.

PLANT CONFIGURATION CONTROL DEFICIENCIES DESCRIPTION OF DEFICIENCY Configuration control was not maintained and physical equipment issues were not documented under a Quality Assurance Plan for the period of time from in which Construction Permits CPPR 122 and CPPR-123 were withdrawn until they were reinstated.

SAFETY IMPLICATIONS There are no safety implications because controls are in place under TVA's corrective action program that will prohibit current plant structures, systems or components, including those affected in the course of resource recovery activities, from being placed into service without being further evaluated and having been fully restored or replaced.

CAUSE OF THE DEFICIENCY From the time in which the BLN Construction Permits were withdrawn in September 2006 until they were reinstated in March 2009, preservation and maintenance activities ceased and some investment recovery activities took place at the Bellefonte site. In this period of time, the BLN Quality Assurance Plan was terminated and configuration control and physical equipment issues were not, and could not be documented under a qualified plan.

CORRECTIVE ACTIONS I. TVA reinstituted BLN's Quality Assurance Plan on March 16, 2009.
