On February 27, 2009, Riverkeeper, Inc. (Riverkeeper) requested that this Licensing Board recognize that Consolidated Contention Riverkeeper EC-3/Clearwater EC-1 (Consolidated Contention) applies against the NRC Staffs analysis in the Draft Supplemental Environmental Impact Statement (Draft SEIS).1 Riverkeeper argues that the NRC Staffs assessment of the spent fuel leaks in the Draft SEIS mirrors that of Entergy in its Environmental Report, thus suffering from the same deficiencies articulated in the Consolidated Contention.2 Entergy and the NRC Staff do not object to the Board treating the Consolidated Contention as a 1 Riverkeeper, Inc.s Challenge to NRC Staffs Assessment of Impacts of Spent Fuel Pool Leaks in the Draft Supplemental Environmental Impact Statement (Feb. 27, 2009) at 3.

challenge to the DSEIS.3 The Board hereby grants Riverkeepers request and recognizes that the Consolidated Contention now applies to the Draft SEIS.
