ORDER On May 8, 2009, the Blue Ridge Environmental Defense League, the Bellefonte Efficiency and Sustainability Team, and the Southern Alliance for Clean Energy (Petitioners) filed a Petition to Intervene and Request for Hearing regarding an NRC order reinstating previously-withdrawn Construction Permits for Bellefonte Units 1 and 2. Contentions 1 and 2 of the Petition state that the NRC lacks statutory authority to reinstate the withdrawn Construction Permits.
The Commission intends to resolve this threshold authority issue before taking action on Petitioners other contentions. To aid the Commission, the Commission directs Petitioners, the Tennessee Valley Authority (TVA), and the NRC Staff (Staff) to submit briefs, of no more than 15 pages, addressing the question whether the NRC possesses the statutory authority to reinstate the withdrawn construction permits. Petitioners, TVA, and the Staff will have 14 days from the issuance of this Order to file their briefs on this question. Thereafter, Petitioners, TVA, and the Staff may file responding briefs, if they choose. The optional responding briefs shall be no more than 10 pages, and shall be filed within 7 days from the filing date of the initial briefs.
All briefs shall be filed in accordance with the E-Filing procedures set for the in the Federal Register notice announcing the opportunity to request a hearing (74 Fed. Reg. 10, 969, March 13, 2009.)
The remainder of Petitioners proposed contentions will be held in abeyance, pending the Commissions ruling on the threshold authority issue. The Commission may refer Petitioners remaining contentions to the Atomic Safety and Licensing Board Panel at a future date. Notwithstanding 10 C.F.R. § 2.309(h), TVA and the Staff should not file answers to the Intervention Petition, other than the briefs described above, pending further order of the Commission.
