TVA hereby acknowledges receipt of the NRC Order granting the reinstatement of the Bellefonte Nuclear Plant Units 1 and 2 Construction Permits (CP Nos. CPPR-122 and CPPR-123) in the terminated status as transmitted in NRC's March 9, 2009 letter to TVA (Reference 1). TVA has placed the units in terminated plant status in accordance with the applicable portions of the Commission's Policy Statement on Deferred Plants (Policy Statement), as published in the Federal Register on October 14, 1987. TVA revised the NQA Plan to include the appropriate QA provisions necessary to address the Bellefonte Units 1 and 2 in terminated status (Reference 2).

In addition, Corrective Action Program steps have been identified and are being implemented to address the period after the Construction Permits were withdrawn and QA oversight had ceased.

TVA is actively working to address the elements of the Policy Statement that apply to a plant in deferred plant status. Included in these efforts are the reinstatement of key programs and procedures which implement applicable NQA Plan requirements. TVA is proceeding in a deliberate manner in order to achieve deferred plant status as soon as practicable. For planning purposes, we anticipate achieving deferred plant status no later than the end of FY 2009 and we will submit a letter informing the NRC of such at the approprýate time.
