SOUTH TEXAS PROJECT, UNITS 1 AND 2 SECURITY IN-OFFICE

INSPECTION REPORT 05000498/2009404 AND 05000499/2009404 -

NOTICE OF VIOLATION

Dear Mr. Halpin:

This refers to the in-office inspection conducted between May 5, 2008, and March 31, 2009, of

your South Texas Project Electric Generating Station facility. The purpose of the inspection was

to follow up on security events that occurred between April 30 and May 1, 2008. The enclosed

report presents the results of this inspection, which were discussed telephonically on March 31,

2009, with Mr. T. Frawley, Manager, Plant Protection, and other members of your staff.

The inspection was an examination of activities conducted under your license as they relate to

security and compliance with the Commissions rules and regulations and with the conditions of

your license. Within these areas, the inspection consisted of selected examination of

procedures and representative records, and interviews with personnel.

Based on the results of this inspection, the NRC has determined that two Severity Level IV

violations of NRC requirements occurred. These violations were evaluated in accordance with

the NRC Enforcement Policy included on the NRC's website at www.nrc.gov/about

nrc/regulatory/enforcement/enforce-pol.html.

The violations are cited in the enclosed Notice of Violation (Notice) and the circumstances

surrounding them are described in detail in the subject inspection report. The violations are

being cited in the Notice because willfulness was involved.

The NRC has concluded that information regarding the reason for the violations and the

corrective actions taken and planned to correct the violation and prevent recurrence, is already

adequately addressed on the docket in Inspection Report No. 05000498/499/2009404,

EA 09-043. Therefore, you are not required to respond to this letter unless the description

herein does not accurately reflect your corrective actions or your position. In that case, or if you

choose to provide additional information, you should follow the instructions specified in the

enclosed Notice.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be

available electronically for public inspection in the NRC Public document Room or from the

Publicly Available Records (PARS) component of NRC's document system, ADAMS. ADAMS is

accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html (the Public

Electronic Reading Room). However, because of the security-related concerns contained in the

enclosure, and in accordance with 10 CFR 2.390, a copy of this letter=s enclosure will not be

available for public inspection.

In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for

your response, if any. This practice will ensure that any response you choose to provide will not

be made available electronically for public inspection in the NRC Public Document Room or

from the NRC's document system, ADAMS. If Safeguards Information is necessary to provide

an acceptable response, please provide the level of protection described in 10 CFR 73.21.

Otherwise, mark your entire response "Security-Related Information-Withhold under

10 CFR 2.390" and follow the instructions for withholding in 10 CFR 2.390(b)(1).
