Dear Mr. Joyce:

The Region I Field Office, NRC Office of Investigations (OI), initiated an investigation (Case No.

1-2008-053) on July 17, 2008, to determine if a supervisor for Steam Generating Team (SGT), a subcontractor working at Salem Unit 2, deliberately instructed workers not to attend a radiation safety briefing before entering a high radiation area (HRA). Based on testimonial and documentary evidence gathered during the OI investigation, the NRC concluded that there was insufficient evidence to substantiate that an SGT supervisor deliberately instructed workers to bypass a radiation safety briefing before entering the HRA.

A number of workers assigned to the work activity involved in the assertion were interviewed by an OI investigator and were unable to supply any direct knowledge that they or other workers made an entry into the HRA without the required briefing. Further, in testimony provided by Salem and SGT management, including an SGT supervisor, the Radiation Protection Manager, and the former General Foreman of SGT at Salem, they indicated that they had no recollection of workers ever being forced into an HRA without having first obtained an HRA briefing. In addition, they testified that each worker was personally responsible for his/her own safety, and that any of the workers who had entered the radiological controlled area would had to have electronically signed a computer radiation work permit, which indicated his/her agreement that an appropriate briefing had been obtained.
