NUCLEAR REGULATORY COMMISSION COMMENTS AND REQUESTS FOR ADDITIONAL INFORMATION TO SUPPORT THE TECHNICAL REVIEW OF NEI 07-01
Dear Mr. Nelson:
By letter dated October 30, 2008 [ADAMS Accession No. ML082960459], the Nuclear Regulatory Commission (NRC) provided you with questions and comments related to your proposed NEI 07-01, AMethodology for the Development of Emergency Action Levels (for)
Advanced Passive Light Water Reactors. By letter dated March 6, 2009, [ADAMS Accession No. ML090700772], NEI submitted a revised version of NEI 07-01 to the NRC for review and endorsement along with responses to the questions and comments. In order to complete our review, the staff has determined that additional information is needed or clarification is required.
In addition, several issues with the document will need to be addressed before the NRC can proceed with the endorsement process. The NRC staff met with your staff and the NEI Emergency Action Level (EAL) Task Force in a public meeting held on April 16, 2009, to discuss this requested additional information and comments. The comments and questions are enclosed [ADAMS Accession No. ML091050459].
My staff has evaluated the revised version of NEI 07-01, along with your responses to the questions and comments we provided to you on October 30, 2008. Unless otherwise identified in the attached enclosure, my staff has no issues or concerns with the responses provided for the questions and comments. However, additional questions and concerns may be identified as NEI 07-01 progresses through the endorsement process.
Please provide a revised NEI 07-01 based upon these questions and comments, and as supported by our discussions with your staff during the pubic meeting held on April 16, 2009.
The NRC requests that a revised document, with responses to the questions and comments, be provided by May 15, 2009.
In addition, by letter dated January 29, 2009, [ADAMS Accession No. ML090300536], you asked if the NRC would consider endorsing an NEI developed standard template for new reactor applicants to use when they respond to NRC Requests for Additional Information (RAIs) related to EALs in new reactor applications. The NRC staff anticipates that the applicant responses to these RAIs should be relatively straight forward, and the content of these responses have been discussed at several design-centered working group public meetings, we have decided not to apply staff resources towards the review and endorsement of this template.
A. Nelson We would like to thank NEI for its effort to develop a guidance document that will assist new reactor applicants in the development of enhanced EALs, and we await your response to the enclosed questions and comments.
