WITHDRAWAL OF THE PROPOSED LICENSE RENEWAL INTERIM STAFF GUIDANCE LR-ISG-2008-01: STAFF GUIDANCE REGARDING THE STATION BLACKOUT RULE (10 CFR 50.63) ASSOCIATED WITH LICENSE RENEWAL APPLICATIONS

Dear Mr. Riley:

The purpose of this letter is to inform you of the U.S. Nuclear Regulatory Commissions (NRC or the staff) decision to withdraw the proposed License Renewal Interim Staff Guidance (LR-ISG),

LR-ISG-2008-01, Staff Guidance Regarding the Station Blackout Rule (10 CFR 50.63)

Associated with License Renewal Applications. The staff issued this proposed LR-ISG to clarify Section 2.5.2.1.1 of NUREG-1800, Revision 1, Standard Review Plan for Review of License Renewal Applications for Nuclear Power Plants (SRP-LR). This section provides acceptance criteria for the scoping of systems, structures, and components (SSCs) relied on in safety analyses or plant evaluations to perform a function that demonstrates compliance with the Commissions regulations for station blackout, in accordance with Section 54.4(a)(3) of Title 10 of the Code of Federal Regulations (10 CFR 54.4(a)(3)).

On March 12, 2008, the staff requested public comments on the proposed LR-ISG in a Federal Register notice (73 FR 13258). By letters dated May 9, 2008, and May 12, 2008, the NRC received comments on the proposed LR-ISG-2008-01 from the Strategic Teaming and Resource Sharing alliance and the Nuclear Energy Institute (NEI), respectively. On July 18, 2008, the staff discussed the results of its review of these comments during a public meeting with NEI and industry representatives. Based on its evaluation of the comments, the staff has determined that SRP-LR guidance regarding scoping of the offsite power system for station blackout recovery does not require further clarification.

Enclosed is a copy of the Federal Register notice announcing the staffs decision and rationale for withdrawing LR-ISG-2008-01. The staff thanks stakeholders for providing comments on the proposed LR-ISG.
