NRC STAFF REVIEW OF NUCLEAR ENERGY INSTITUTE 03-12 TEMPLATE FOR SECURITY PLAN, TRAINING AND QUALIFICATION, SAFEGUARDS CONTINGENCY PLAN, [AND INDEPENDENT SPENT FUEL STORAGE INSTALLATION SECURITY PROGRAM] (REVISION 6)
Dear Mr. Roe:
As you know, the U.S. Nuclear Regulatory Commission (NRC) recently completed an extensive rulemaking to amend the security requirements for nuclear power reactors. The final power reactor security rule (final rule) was published in the Federal Register on March 27, 2009. On February 23, 2009, you submitted NEI 03-12, Revision 6, Template for the Security Plan, Training and Qualification Plan, Safeguards Contingency Plan, [and Independent Spent Fuel Storage Installation Security Program], for the endorsement of the NRC as a generically acceptable method for NRC power reactor licensees to implement the requirements of the final rule.
After several meetings with your staff and the industry, the NRC staff has concluded the NEI 03-12, Revision 6 is generically acceptable for use by NRC power reactor licensees to meet the security plan (physical security plan, training and qualification plan, safeguards contingency plan) requirements of the final rule. In addition, the Regulatory Guides that support this rulemaking will recognize the latest NRC - endorsed revision of NEI 03-12 as acceptable for use to develop the aforementioned security plans. Licensees choosing to use NEI 03-12, Revision 6, would still be required to develop and maintain site - specific security plans that address all of the applicable 10 CFR Part 73 requirements.
