ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White Significance Determination Process finding will be issued on or about April 3, 2009, to Constellation Energy as a result of inspections at Calvert Cliffs Nuclear Power Plant. This White finding, an issue with low to moderate safety significance which may require additional NRC inspection, was associated with the procedure quality attribute of the Emergency Preparedness cornerstone and affected the cornerstone objective of ensuring that the licensee is capable of implementing adequate measures to protect the health and safety of the public in the event of a radiological emergency. Specifically, on August 31, 2005, the licensee revised the emergency action level (EAL) table for potential loss of containment integrity in a manner that could have prevented declaration of a Site Area Emergency in a timely manner. The EAL basis document correctly described the conditions that would indicate a potential loss of the containment barrier function.
However, an error was made in translating the EAL basis document into the table in the EALs used by plant staff to assess plant conditions during an actual event. This error could have resulted in an incorrect and non-conservative determination of containment barrier functionality during an accident. This White finding will result in Calvert Cliffs transitioning from the Licensee Response Column of the Action Matrix to the Regulatory Response Column.
The Notice of Violation is included based on the licensees failure to meet 10 CFR 50.47(b)(4),
which requires that a licensee maintain in effect a standard emergency classification and action level scheme, the basis of which include facility system and effluent parameters, and 10 CFR 50, Appendix E, which requires that the means to be used for determining the magnitude of, and for continuously assessing the impact of, a release of radioactive materials be described, including EALs. Contrary to this, the licensee failed to maintain emergency plans with met the requirements of 10 CFR 50.47(b)(4) and 10 CFR 50, Appendix E, in that the EAL table for the fission product barrier matrix contained an inaccurate EAL threshold associated with potential loss of containment barrier.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
