Dear Mr. Orf:

This letter serves to document the undersigneds request for a copy of the Florida Power and Light Companys (FPLs) written response to security related issues regarding the licensees operation of the Turkey Point Nuclear Plants. As you may recall, in an email dated January 6, 2009, you stated that:

... At this time, the NRC has not received from FPL a written response to the security violations (EA-07-138) at the Turkey Point Nuclear Plant. FPLs response was due to the NRC within 120 days of the NRCs response to FPLs FOIA request on the same notice of violation. It is my understanding that the response to the FOIA request was completed before the end of the year, so FPLs response to the violations should be forthcoming in the near future. Once I have a copy of FPLs response, I will forward a copy to you...

In a follow-up email to your attention dated March 14, 2009, the undersigned again requested a copy of FPLs written response to the Turkey Point Nuclear Plant security violations. However, to date, you have not replied or responded to the email.

To the extent that public health and safety requires the NRC to ensure that FPLs Turkey Point Nuclear Plants are operated in full compliance with NRC regulations and to the extent that the NRC has made a written commitment to provide the undersigned with a copy of FPLs written response to the security violations addressed in (EA-08-138), you are again urged to provide requested information as soon as possible. In addition, please provide an estimation of exactly when the document will be provided.
