Jim, As I mentioned over the phone, one correction is that the phone call where these items were discussed was on February 12, 2009, not January 26. The call on January 26, 2009, had to be rescheduled due to one of the staff being called away at the last minute.

The staff also wants to add that while it was suggested not to mention TSTF 493, they said to make sure that all changes to setpoints address conformance with the criteria in RIS 2006-17.

The rest of what you stated is accurate.

RE: TSTF-493 Phone call with NRC regarding EPU Justin, Is this the way you recollect the outcome of the phone call. I know it has been a long time but I need to be sure down the road that we are both aligned. Thanks, Jim On January 26th a teleconference was held between NRC staff and the principal reviewer for the ESFAS and RPS Tech spec tables instrumentation changes.

The NRC aggreed to:

1. review all changes on the ESFAS and RPS tables as part of the EPU submittal understanding that some of the changes were not affected by EPU
2. PBNP submitting a note in lieu of a value for the AFW swapover setpoint. The note would state that PBNP would commit to provide this value no later than June 30, 2009.

The NRC also stated that we should not mention TSTF 493 anywhere in our submittal. We stated that when the TSTF-493 was issued, we would submit any subsequent TS changes affected by this TSTF.
