Dear Mr. Pollock:
The Region I Field Office, NRC Office of Investigations (OI), initiated an investigation (Case No.
1-2008-039) on April 1, 2008, to determine whether an Entergy Nuclear Northeast (Entergy) employee based in the Corporate Office in White Plains, New York, deliberately refused to submit to a random Fitness-For-Duty (FFD) test on December 5, 2007, and whether an Entergy Senior Manager deliberately failed to respond to the refusal. Based upon testimonial and documentary evidence gathered by OI, the NRC did not substantiate that Entergy employees deliberately violated NRC regulations regarding the FFD test. Specifically, OI found, based on a review of licensee records and sworn testimony, that the employee had taken an FFD test at the White Plains Office on December 5, 2007, as directed and within the confines of Entergys FFD procedure.
