Dear Commissioners,

Greetings. I am Peekskill resident who has been concerned for a long time about the safety and management of Indian Point. In a March 4 article in the North County News, one of our local papers, reporter Abby Luby wrote about the Nuclear Regulatory Commission's decision not to fine Entergy for failing to complete the installation of the siren system.

I was hoping you would be able to explain the reasons behind the NRC's decision. From what I understand, the new system was set up almost two years after the original deadline. Apparently, Entergy missed three deadlines in the process. Needless to say, Entergy's struggle to surmount technical difficulties does not fill me with confidence with regard to their ability to maintain and run a nuclear power plant safely.

According to the North County News article, the NRC could have imposed a fine of $130,000 daily but chose not to.ý, I would be interested to learn why no daily fine was imposed. It seems one commissioner, Dr. Jaczko, was6concerned that a lack of regulatory enforcement by the NRC would indicate lax oversight. Dr. Jaczko'.

concern is correct. It would seem appropriate that the NRC require Entergy to pay the appropriate penalty for violating NRC orders.

While Commissioner Klein is quoted as saying that fining Entergy would "amount to no more than an expression of regulatory outrage," I must disagree strongly. If Entergy is not capable of running Indian Point as safely, indeed flawlessly, as possible, it endangers the health and well-being of millions of citizens, not to mention natural habitats. If the NRC does not act in a way that ensures its regulations are carried out in a careful and vigorous way, it appears to the public to be complicit with a company that has not demonstrated its competence.

As a citizen, I appreciate and thank you for the work that all of you do to make sure the nuclear industry functions as safely as possible. I would remain interested in learning, however, about the reasons behind this recent decision.
