Our biologists have completed the assessment, and we will issue it for your review within the next few (likely 2) weeks after it goes through our concurrence process.

As for the draft supplemental EIS, the electronic version is available at http://www.nrc.gov/reading-rm/doc-collections/nuregs/staff/sr1437/supplement38/. I will forward a hard copy of the draft supplemental EIS along with the EFH assessment and I will send it directly to you, as requested below. Please let me know if I should also send a copy to Gloucester, as we have a few additional copies available.

Dear Drew:

We have not met, but I am the NOAA/NMFS staff person that will be working on the Indian Point relicensing on matters other than Endangered Species Act coordination. This e-mail is intended to follow up with you on a letter sent to the NRC on February 28, 2008 by my manager [Peter D.

Colosi, Jr. NMFSs Assistant Regional Administrator for Habitat Conservation] regarding our Division's participation and information needs to go forward with inter-agency coordination for Indian Point Nuclear Generating Units 2 & 3. In this correspondence, Mr. Colosi notified the NRC that an essential fish habitat [EFH]

assessment would be necessary before we could make any specific comments or recommendations regarding the relevant relicensing matters before the NRC in this proceeding. We have had no subsequent coordination with the NRC on these matters since Mr. Colosi's letter was issued early last calendar year.

In addition to the NRCs EFH assessment, it recently came to our attention while coordinating with colleagues from another agency that a draft supplemental environmental impact statement [DSEIS] was prepared for this 1

project. We were not previously aware that this document had been issued. After examining our incoming correspondence records, we determined that HCD did not receive a copy of the DSEIS to review. In order that HCD may provide consolidated comments on these matters, we ask that you send these documents and any accompanying information that may be necessary at your earliest convenience. As I am not stationed in Gloucester, it would be great if you sent these materials to me directly so they don't need to be re-shipped here

[see contact information below]. If these documents are not yet ready to be released, I'd appreciate it if you could give me an approximate window of when they may be expected so I can block out some time to review them and compile a response.

Thank you in advance for your assistance in this matter. A short letter to this effect also has been sent to the NRC.
