In Reference 2, the Omaha Public Power District (OPPD) requested a change to Fort Calhoun Station (FCS), Unit No. 1, Renewed Operating License No. DPR-40, to clarify Technical Specification (TS) 2.7(2)j regarding emergency diesel generator (DG) allowed outage time (AOT). The NRC staff reviewed the proposed change and in an email dated February 17, 2009 (Reference 3) transmitted an alternative to the wording proposed by OPPD.

The alternative wording is intended to clearly delineate that the seven consecutive days of DG allowed outage time must not be misconstrued to imply 14 consecutive days in two months (i.e. 7 days at the end of one calendar month followed by 7 days at the beginning of the following month).

OPPD noted in the evaluation accompanying the proposed TS change that operation in such a manner was not consistent with the Reactor Oversight Process, or the Maintenance Rule (10 CFR 50.65(a)(4)), which considers all inoperable risk-significant equipment, not just the one or two systems governed by the same LCO.

Nuclear Regulatory Commission LIC-09-0014 Page 2 OPPD has reviewed and approved the change requested by the NRC and it is incorporated in the attached markup page and clean. page, which supersede the pages provided with Reference 2. As the change is a clarification, the conclusion of the evaluation provided by Reference 2 that the change presents no significant hazards consideration under the standards set forth in 10 CFR 50.92(c), remains valid.

As requested, OPPD will process a TS Basis Change (TSBC) to be implemented with the amendment. The TSBC will further clarify that the seven consecutive days of DG allowed outage time must not be misconstrued to imply 14 consecutive days in two months (i.e. 7 days at the end of one calendar month followed by 7 days at the beginning of the following month).

This is a one-time commitment.
