Dear Mr. Swafford:
The purpose of this letter is to acknowledge the March 4, 2009, letter from Tennessee Valley Authority (TVA) that withdrew a request for Nuclear Regulatory Commission (NRC) approval of a proposed exemption from Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Appendix R, paragraph III.G.2, "Fire Protection of Safe Shutdown Capability," which had been submitted on January 27, 2009. TVA plans to adopt National Fire Protection Association (NFPA) Standard 805, "Performance-Based Standard for Fire Protection for Light Water Reactor Electric Generating Plants, 2001 Edition," at Browns Ferry Nuclear Plant in accordance with 10 CFR 50.48(c). 10 CFR 50.48(c), in conjunction with NFPA 805, provides an alternate, performance-based method to comply with NRC fire protection requirements.
The NRC staff has terminated its review of the proposed change and TAC Nos. ME0626, ME0627, and ME0628 have been closed. An Environmental Assessment had not been prepared or published in the Federal Register.
