50-260 50-296 BROWNS FERRY NUCLEAR PLANT (BFN) - UNITS 1, 2, AND 3 -WITHDRAWAL OF PROPOSED REQUEST FOR EXEMPTION FROM 10 CFR 50, APPENDIX R, PARAGRAPH III.G.2, FIRE PROTECTION OF SAFE SHUTDOWN CAPACITY By letter dated January 27, 2009, to NRC from F. R. Godwin, BFN requested an exemption from the provisions of 10 CFR 50, Appendix R, Paragraph III.G.2, Fire Protection of Safe Shutdown Capability, for the use of operator manual actions on Units 1, 2, and 3 as a means to ensure one redundant safe shutdown train is free of fire damage.

The purpose of this letter is to withdraw the above referenced request for exemption from Appendix R, Paragraph III.G.2. TVA plans to adopt National Fire Protection Association (NFPA) Standard 805, "Performance-Based Standard for Fire Protection for Light Water Reactor Electric Generating Plants, 2001 Edition," at BFN in accordance with 10 CFR 50.48(c).

10 CFR 50.48(c), in conjunction with NFPA 805, provides an alternate, performance-based method to comply with NRC fire protection requirements. NRC has encouraged licensees to consider the benefits of transitioning plant fire protection programs from their current prescriptive requirements to the new NFPA 805 standard.

TVA recognizes that the overall benefit of NFPA is in ensuring optimum focus on enhancing plant safety through the use of performance-based standards and risk informed decision-making techniques.

TVA will submit a separate letter of intent to transition BFN Units 1, 2, and 3 to the NFPA 805 standard.
