The U.S. Nuclear Regulatory Commission (NRC) is continuing the review of your application for renewal of Facility Operating License No. R-2 for the Pennsylvania State University Penn State Breazeale Reactor dated December 6, 2005, as supplemented by letter dated October 31, 2008. During NRC staff review it was determined that additional information and clarification contained in the enclosure is required to continue the review. Please provide a response to the enclosed request for additional information no later than April 10, 2009. In accordance with Title 10 of the Code of Federal Regulations Part 50.30(b), your response must be executed in a signed original under oath or affirmation.

OFFICE OF NUCLEAR REACTOR REGULATION REQUEST FOR ADDITIONAL INFORMATION PENNSYLVANIA STATE UNIVERSITY PENN STATE BREAZEALE REACTOR DOCKET NO.50-005 The U.S. Nuclear Regulatory Commission (NRC) is continuing the review of your application for renewal of Facility Operating License No. R-2 for the Pennsylvania State University Penn State Breazeale Reactor (PSBR) dated December 6, 2005, as supplemented by letter dated October 31, 2008. The following requests for additional information are based on a comparison of the PSBR emergency plan, dated September 21, 2000 vs. American National Standard ANSI/ANS-15.16, Emergency Planning for Research Reactors, dated May 2000, and NUREG-0849, Standard Review Plan for the Review and Evaluation of Emergency Plans for Research and Test Reactors, dated October 1983.

1. Please provide the frequency for updating the written agreements with the primary fire-fighting agency (Section 3.1.6) and medical facility provider (Section 3.1.9) and indicate whether updating these agreements is governed by a PSBR procedure. Provide a current copy of each of these agreements.
2. Do PSBR procedures require notification of the NRC in approximately one hour for emergency class declarations? If not, review NRC Information Notice 92-79, Non-power Reactor Emergency Event Response, and revise accordingly.
3. Please provide a copy of the NRC Operations Center notification form discussed in Section 7.1.
4. Describe any sources of meteorological data representative of the PSBR site that would be used during an emergency that warrants use of such data. Are any meteorological data sources indicated in the PSBR procedures?
5. What type of initial and periodic retraining is offered to emergency response support personnel, i.e., first aid responders, fire fighters, and medical personnel? Please discuss PSBR procedural requirements that govern this training.
