Lawrence G. McDade, Chairman E. Roy Hawkens Nicholas G. Trikouros In the Matter of Docket No. IA-05-021-EA ANDREW SIEMASZKO ASLBP No. 05-839-02-EA February 27, 2009 Notice and Order (Scheduling Telephonic Status Conference)
In light of the recent sentencing of Andrew Siemasko in the Northern District of Ohio on February 6, 2009, the Board is confirming the informal notice provided to the parties via e-mail on Tuesday, February 24, 2009, that it will convene a telephonic status conference, to be held Thursday, March 19, 2009, at 2:00 P.M. EST. The purpose of the call is to determine the course Mr. Siemaszko wishes to pursue in this administrative enforcement proceeding given the outcome of his criminal trial. If Mr. Siemaszko wishes to go forward, the conference call will provide an opportunity to discuss matters that need to be addressed to bring this proceeding to its conclusion (e.g., discovery, motions, briefings, etc.) as well as scheduling issues. The information needed to connect to this call, which is expected to last about 30 minutes, will be provided to counsel for both parties during the second week of March.
To enhance the effectiveness of the status conference call, the Board requests that Mr.
Siemaszkos counsel: (1) provide the Board and Staff counsel with a copy of the indictment; (2) identify those charges underlying Mr. Siemaszkos conviction; and (3) advise whether the jury received instructions regarding the different theories for finding that Mr. Siemaszko acted
knowingly and, if yes, whether the jury rendered a general or special verdict. This information should be submitted to the Board and Staff counsel by March 12, 2009.
