KEWAUNEE POWER STATION ASSESSMENT FOLLOWUP LETTER

Dear Mr. Christian:

On October 29, 2008, the NRC staff completed, as part of our continuous review, an update of our assessment of the Kewaunee Power Station. The assessment evaluated performance indicators (PIs) and inspection results. The purpose of this letter is to inform you of your safety performance during this period and our plans for a future inspection at your facility. This letter supplements, but does not supersede, our mid-cycle assessment letter issued on September 2, 2008.

On October 29, 2008, the NRC staff forwarded a letter concerning the final significance determination of a White inspection finding in the emergency preparedness cornerstone.

This White finding involved a violation of 10 CFR 50.54(q) associated with planning standard 50.47(b)(4), failure to maintain a standard emergency classification and action level scheme based on facility system and effluent parameters. Specifically, two Emergency Action Levels, RA1.1 and RA1.2, contained incorrect setpoint values used for declaring Alert emergencies.

As a result, action directed by the State and local emergency response plans, which rely on information provided by the licensee, could have potentially delayed minimum initial offsite response measures.

As a result of this White finding, we have assessed Kewaunee Power Station performance to be within the regulatory response column of the NRCs Action Matrix beginning the third quarter of 2008. Therefore, in addition to the baseline inspections, we plan to conduct Supplemental Inspection 95001, "Inspection for One or Two White Inputs in a Strategic Performance Area,"

following completion of your root cause analysis and implementation of corrective actions. This inspection procedure is conducted to provide assurance that the root causes and contributing causes of risk significant performance issues are understood, the extent of cause and condition are identified, and the corrective actions are sufficient to prevent recurrence. Please notify Hironori Peterson at 630-829-9707 once you have completed your root cause analysis and when you are ready for our supplemental inspection to occur.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS),
