TURKEY POINT NUCLEAR GENERATING UNIT 4 - REQUEST FOR INTERNATIONAL ATOMIC ENERGY AGENCY (IAEA) INFORMATION REGARDING THE ADDITIONAL PROTOCOL TREATY

Dear Mr. Nazar:

On June 12, 1998, the United States Government signed the Protocol Additional to the Agreement between the United States of America and the International Atomic Energy Agency for the Application of Safeguards in the United States of America (Additional Protocol Treaty).

On December 23, 2008, the l\\Iuclear Regulatory Commission's direct 'final rule to implement the Additional Protocol Treaty was published in the Federal Register. Turkey Point Unit 4 is a facility identified under Article 39(b) of the principal text of the U.S.lIAEA Safeguards Agreement.

Pursuant to Title 10, Code of Federal Regulations (10 CFR), Part 75, as presented in the direct final rule, Turkey Point Unit 4 is directed to complete and submit facility information as described in 10 CFR 75.10(b)(5). As specified in 75.10(e), this information must be submitted as outlined by instructions in Department of Energy/Nuclear Regulatory Commission (DOE/NRC)

Form AP-A and associated forms and shall contain a site map drawn to scale as an attachment.

Copies of the instructions for DOC/NRC Form AP-A and associated forms can be found on the Department of Commerce website at http://www.bis.doc.qov/ap/apsiteshandbooks.htm. We request that the information be submitted within 20 days from the date of this letter.

With your timely submittal, the United States will meet its international obligations as specified in the Additional Protocol Treaty.
