Dear friends:

I understand that after many years of stalling that the Yucca Mountain site is still far from licensure. The U.S. government's assurance that there will eventually be a respository for the nation's burgeoning stockpile of nuclear wastes is no nearer to being a reality than it was the day it was made.

But that is no reason to revisit the "Waste Confidence Rule" and to somehow magically extend it into the next half a century! On the contrary, we expect science and honesty to prevail on our nuclear regulators. As yoh have reserved for yourselves the safety of our nuclear plants, and prevented States from examining any part of that aspect of our'nuclear facilities, we expect and rely on a clear-eyed, pro-saftey - not pro-industry - regulatory agency.

We have, in fact, no confidence in the current Waste Confidence Rule. Extending it in the absence of any concrete changes in the political and scientific evidence will only worsen the matter. We have little confidence, in fact, in your agency which has spent its time splitting hairs with communities all across this land while granting exceptions right and left to what you and we know to be the best practice management of nuclear power facilities and waste storage.

We live in a more dangerous world. Terrorism is a real and viable threat to our nuclear waste storage facilities and to our nuclear power plants. The aged Vermont Yankee plant in Vernon, VT is less than five miles from my home. It is also within easy mortar range of the mountains in New Hampshire that are directly across the Connecticut River. There is a waste storage pool seven stories above the ground inside that plant. If five guys with box cutters could bring down those planes on September lith, what makes you think that this plant is safe.

You must take into account the longterm environmental impact of not just accidents, which Vermont Yankee has had a plenty, and lax maintenance, but of mallicious attacks. It takes only a rocket propelled grenade or a simple mortar shell or a private plane to render all of New England and all the land in the watershed of the Connecticut River uninhabitable.

It would be criminally stupid not to consider the very real threats we now face as you review applications for licensure extension and for on-site or future waste storage.

We pray that you will do so.
