Confidentiality The location, character, and ownership of archaeological sites (including underwater shipwrecks) are protected from disclosure by Section 304 (16 USC 4702-3) of the National Historic Preservation Act of 1966 and Section 427.8 of the implementing regulations of the State Historic Preservation Act of 1980. This information is held confidential in order to protect these sites from pothunting and commercial looting, as well as to protect the privacy of the landowners. Only 36 CFR 61 qualified archaeologists and designated representatives of State or Federally recognized Native American tribes will be provided access to Archaeological Site files, Archaeological Report library and Underwater Shipwrecks database.
