ORDER On December 9, 2008, the NRC Staff filed a petition for review of the Atomic Safety and Licensing Boards partial initial decision, LBP-08-25 (Nov. 24, 2008). On December 17, 2008, intervenor New England Coalition filed a motion for reconsideration of the same decision with the Board. The Commissions practice under such circumstances is to hold the appellate proceeding in abeyance pending the Boards resolution of the motion for reconsideration. See Public Service Co. of New Hampshire (Seabrook Station, Units 1 and 2), ALAB-933, 31 NRC 491, 498 (1990); 10 C.F.R. § 2.341(b)(6).
Therefore, pursuant to my authority under 10 C.F.R. § 2.346(e) and (j), the Staffs petition for review is hereby placed in abeyance until further order of the Commission.
