ACKNOWLEDGMENT OF LETTER REQUESTING ENFORCEMENT DISCRETION FOR 10 CFR PART 26 IMPLEMENTATION
Dear Mr. Walters:
By letter dated December 24, 2008, the Nuclear Energy Institute (NEI) submitted to the NRC information supporting a request that enforcement discretion be granted to reactor licensees when the fatigue management requirements of the new 10 CFR Part 26, Fitness for Duty Programs, become effective on October 1, 2009. Specifically, on behalf of the industry, NEI asked that enforcement discretion be granted during the first six months of implementation of the requirements pertaining to fatigue management contained in 10 CFR Part 26, Subpart I.
The Office of Nuclear Reactor Regulation (NRR) has been assigned the lead for responding to your request. You will be informed of the staffs decision within 45 days. Notwithstanding NRRs future response to your December 24, 2008 letter, the industry should continue to prepare for a timely implementation of the rule on October 1, 2009.
