INDUSTRY WHITE PAPER ON A REGULATORY FRAMEWORK FOR CLOSING THE FUEL CYCLE

Dear Mr. Fertel:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letters of December 19 and 24, 2008, regarding the Nuclear Energy Institutes (NEI) white paper on a proposed regulatory framework for licensing a commercial spent fuel reprocessing facility. As you are aware, NRC staff is currently completing a regulatory gap analysis to identify enhancements to the regulatory framework for licensing a reprocessing facility and plans to develop the technical basis for potential rulemaking by mid-2010. NRC staff will consider the white paper as we develop the revised regulatory framework to efficiently and effectively review potential applications for commercial reprocessing facilities.

The staff understands that the white paper is a collaborative industry effort resulting from NEIs task force, Closing the Fuel Cycle, which consists of representatives from industry and NEI. We appreciate the effort invested by the task force in attempting to systematically identify needed enhancements to the regulatory framework. NRC has also been informed that other stakeholders are interested in discussing enhancements. NRC staff is prepared to interact with the NEI-led task force, other stakeholders, and the public, to begin an open dialogue about the enhancements identified in the white paper. We also understand NEIs interest in arranging a public workshop immediately following the Fuel Cycle Information Exchange (FCIX) in June 2009. NRC is currently in the process of establishing a schedule for the FCIX and our staff will be in contact with your staff as we finalize the agenda.
