RETURN OF ORIGINAL FINANCIAL ASSURANCE DOCUMENTS REGARDING THE WESTINGHOUSE ELECTRIC COMPANY LLC WALTZ MILLS SITE AND THE CBS FORMER TR-2 TEST REACTOR FACILITY IN MADISON, PENNSYLVANIA

Dear Ms. Thomas:

In accordance with NRC regulations, CBS Corporation has been required to maintain decommissioning financial assurance for facilities at the Waltz Mills site in Madison, PA. CBS provided decommissioning financial assurance for the former TR-2 test reactor at this location and provided a portion of the decommissioning financial assurance that was used by Westinghouse Electric Company LLC (Westinghouse) to meet a portion of its financial assurance obligations for the SNM-770 license, also located at the Madison, PA site.

On March 26, 2008, the NRC amended the Westinghouse SNM-770 license to incorporate the residual radioactive material possessed under the CBS TR-2 license. In this amendment, the NRC accepted certain additional decommissioning financial assurance commitments from Westinghouse. On September 19, 2008, the NRC completed action on the CBS request to terminate the TR-2 license [ML081330398]. As a result of the transfer of the residual radioactive materials associated with the former TR-2 test reactor to Westinghouse, the additional decommissioning financial assurance commitment from Westinghouse, and the termination of the CBS TR-2 license, CBS is no longer obligated to maintain financial assurance for decommissioning, since it will no longer have any decommissioning obligations to assure.

Therefore, as a result of these administrative actions taken by the NRC regarding the Westinghouse SNM-770 and the CBS TR-2 licenses, we are returning the following original financial assurance documents, because decommissioning financial assurance is no longer required to be maintained by CBS.

When detached from enclosures, this document is decontrolled.
