Dear Mr. Bhatnagar:
By letter to the Nuclear Regulatory Commission (NRC) dated August 26, 2008, as supplemented September 25, 2008, Tennessee Valley Authority submitted a request for authorization to reinstate the Construction Permits CPPR-122 and CPPR-123 for Bellefonte Nuclear Plant, Units 1 and 2, respectively.
The NRC staff is reviewing TVAs submittal and has determined that additional information is needed to complete its review. The specific information requested is addressed in the enclosure to this letter.
This request for additional information was discussed with members of your staff, and it was agreed that a response would be provided within 14 days of the date of this letter. If circumstances result in the need to revise the requested response date, please contact me at (301) 415-1457.

REQUEST FOR ADDITIONAL INFORMATION BELLEFONTE NUCLEAR PLANT UNITS 1 AND 2 DOCKET NOS. 50-438 AND 50-439 By letter to the Nuclear Regulatory Commission (NRC) dated August 26, 2008, as supplemented September 25, 2008, Tennessee Valley Authority (TVA) submitted a request for authorization to reinstate the Construction Permits CPPR-122 and CPPR-123 for Bellefonte Nuclear Plant (BLN), Units 1 and 2, respectively.
The TVA letter, dated August 26, 2008, stated that the environmental impacts associated with the construction of BLN Units 1 and 2 have been previously discussed and evaluated by TVA in accordance with its National Environmental Policy Act obligations as a federal agency, as well as by the NRC consistent with its domestic licensing and related regulatory authority.
The most recent NRC environmental assessment (EA) for BLN Units 1 and 2, was completed on January 16, 2003 (see Agencywide Document and Access Management System Accession No. ML030170463), for the extension of CPPR-122 and CPPR-123, respectively. In preparing that EA, the NRC staff requested additional information (ML021560599) from TVA regarding changes to construction-related impacts documented in the 1974 Final Environmental Statement (FES) for CPPR-122 and CPPR-123. By letter dated August 26, 2002 (ML022400277), TVA provided its response to the NRC.
In order to adequately assess the environmental impacts associated with TVAs request to reinstate CPPR-122 and CPPR-123, the NRC staff will evaluate any deviation from the original proposal to construct BLN, Units 1 and 2, and all impacts associated with such deviation, as compared to the 1974 FES. Accordingly, the NRC staff requests a response to the following questions:
REQUEST FOR ADDITIONAL INFORMATION (RAI) QUESTIONS
- 1. With respect to TVAs RAI responses, dated August 26, 2002, please confirm whether the responses remain full and accurate, and if not, what new or updated information regarding construction impacts pertains to the current request for reinstatement of CPPR-122 and CPPR-123. If there is new or updated information, please provide such, as appropriate. In addition, please disclose any other activities that may have occurred since the September 14, 2006, termination of CPPR-122 and CPPR-123 that may have impacts to the environment and/or natural resources.
- 2. With respect to TVAs response to Question 2 of the NRC staff RAI, dated June 5, 2002, regarding facilities that remain to be constructed, please confirm that any impacts to natural resources (e.g., aquatic, terrestrial, air quality, water quality, etc.) from such projected construction activities would remain within scope of the assessment conducted for the 1974 FES.
- 3. Please provide any changes or updates to the construction-related radiological impacts assessed in the 1974 FES.
