HUMBOLDT BAY POWER PLANT UNIT 3 - TERMINATION OF ORDER FOR IMPLEMENTATION OF ADDITIONAL SECURITY MEASURES ASSOCIATED WITH ACCESS AUTHORIZATION, FITNESS FOR DUTY AND BEHAVIOR OBSERVATION (EA-03-099)

Dear Mr. Conway:

On August 18, 2004, the U.S. Nuclear Regulatory Commission (NRC) issued an Order for Implementation of Additional Security Measures Associated with Access Authorization, Fitness for Duty and Behavior Observation to Pacific Gas and Electric Company (PG&E) for Humboldt Bay Power Plant, Unit 3. This Order applied to decommissioning nuclear power plants with spent fuel in the spent fuel pool. By correspondence dated December 11, 2008, you have reported that all fuel has been removed from the spent fuel pool and have requested that the Order be rescinded. Accordingly, as provided in Section III of the Order, I hereby grant your request and rescind the Order. PG&E shall continue to adhere to the terms and conditions of the Humboldt Bay Power Plant, Independent Spent Fuel Storage Installation license and the Commission's regulations.
