With regard to the PRB teleconference on sleeping guards at Turkey Point, I was able to confirm today that the NRC's response to FPL's Freedom of Information Act (FOIA) request has not yet been completed. Because of the size of the request, it is difficult to gauge the remaing time to complete the request. Since FPL's response to the notice of violation is expected 120 days after they receive the NRC's response to the FOIA request, speculating, I would expect FPL to respond in January or February.

I am contacting you to ask if would like to continue your petition review board (PRB) presentation of August 14, 2008. A meeting has been tentatively scheduled for Wednesday, September 17, from 9:00 am to 10:00 AM EDT. If you would like to participate and are able to attend at that time, please let me know at your earliest convenience so that a bridge line and court transcriber can be arranged. I apologize for the last meeting where the meeting was cut short.
Earlier discussions had not lasted as long as the recent meeting and it had not occurred to me to mention the time limit since more time for that meeting had been scheduled than in the past.
I must also advise you that the PRB's initial recommendation is to not accept your request into the 2.206 petition process as the issues presented to date have already been the subject of NRC staff review and evaluation and no significant new information has been provided.
