MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN VERMONT YANKEE NUCLEAR POWER STATION

Dear Mr. Sullivan:

On August 7, 2008, the NRC staff completed its performance review of the Vermont Yankee Nuclear Power Station for the first half of the calendar year 2008 assessment cycle. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results over the previous twelve months. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.

This performance review and enclosed inspection plan do not include physical protection information. A separate letter designated and marked as AOfficial Use Only - Security Related Information will include the physical protection cornerstone review and resultant inspection plan.

Plant performance for the three most recent quarters was within the Licensee Response column of the NRCs Action Matrix based on all inspection findings being classified as having very low safety significance (Green) and all PIs indicating performance at a level requiring no additional NRC oversight (Green). There was a finding of low to moderate safety significance (White) in the Public Radiation Safety cornerstone in the third quarter of 2007, the NRC completed a supplemental inspection and documented the results in NRC Inspection Report 05000271/2007009. As a result of that inspection, this finding was closed, and was not considered for current plant assessment purposes. Therefore, we plan to conduct reactor oversight process (ROP) baseline inspections at your facility. In addition, we plan to conduct an independent spent fuel storage installation inspection.

The staff identified that there were six Green findings for the current twelve month assessment period with a documented cross-cutting aspect in the area of human performance, and that there was a common cross-cutting theme associated with these findings. The theme was a failure to ensure that complete, accurate, and up-to-date design documentation, procedures, and work packages were available and adequate to assure nuclear safety H.2(c). As a result of the apparent cause evaluation and the common cause analysis that you performed to address the cross-cutting theme, you identified that procedure adequacy was a contributor to a larger problem at Vermont Yankee with respect to procedure use and compliance.

Sullivan 2 In evaluating the scope of efforts and progress in addressing the cross-cutting theme, the NRC staff determined that Entergy has recognized the cross-cutting theme and has initiated action to develop a procedure quality improvement plan. Therefore, the staff has determined that a substantive cross-cutting issue in human performance does not exist at this time. We will monitor your progress in the area of procedure adequacy through the baseline inspection program, including a focused review of your proposed corrective action plan. In addition, we will review your progress and completed actions during the biennial problem identification and resolution inspection scheduled for the second quarter of 2009.

The enclosed inspection plan details the inspections, less those related to physical protection, scheduled through December 31, 2009. The inspection plan is provided to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last nine months of the inspection plan are tentative and may be revised at the end-of-cycle safety performance review.

In accordance with 10CFR2.390 of the NRC=s ARules of Practice,@ a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
