GUIDANCE PROCESS AND NRC REGULATORY ISSUE SUMMARY 2007-16

Dear Ms. Keys and Other Stakeholders:

The U.S. Nuclear Regulatory Commission (NRC or the staff) is informing you of the opportunity

to provide comments on the staffs Draft License Renewal Interim Staff Guidance (ISG)

LR-ISG-2007-01, entitled License Renewal Interim Staff Guidance Process, Revision 1

(LR-ISG process). The staff also requests comment on a proposed revision to NRC Regulatory

Issue Summary (RIS) 2007-16, Implementation of the Requirements of 10 CFR 54.37(b) for

Holders of Renewed Licenses. The proposed revisions to the LR-ISG process and RIS are

enclosed and available in the NRCs Agencywide Documents Access and Management System

(ADAMS), under Accession Nos. ML082180346 and ML083500028, respectively.

Once approved, the revised LR-ISG process will supersede the existing guidance entitled, The

Interim Staff Guidance Process, issued on December 12, 2003 (ML023520620). The proposed

revision includes several updates to the existing ISG process. One update involves enhanced

review and documentation of determinations on the applicability of the provisions of

Section 54.37(b) of Title 10 of the Code of Federal Regulations (10 CFR 54.37(b)), and the

requirements of Section 50.109, Backfitting, of 10 CFR (10 CFR 50.109) to LR-ISGs. This

update addresses recommendations made in a report issued by the NRCs Office of the

Inspector General, OIG-07-A-15, Audit of the NRCs License Renewal Program, dated

September 6, 2007 (ML072490486). Another update involves extending the LR-ISG process to

include certain guidance documents associated with environmental reviews for license renewal

applications. The staff is also proposing to eliminate the previous clarification and

compliance LR-ISG designations. As an alternative, the staff will document the basis for

applicability of 10 CFR 54.37(b) or 10 CFR 50.109 in a proposed new backfitting discussion

section of each LR-ISG. Other updates include administrative changes, such as references to

the NRCs organizational structure.

The staff also identified the need to revise RIS 2007-16 to address recommendations from

OIG-07-A-15. The proposed RIS revision clarifies the requirements of 10 CFR Part 54 and the

role of the LR-ISG process for including newly identified SSCs under 10 CFR 54.37(b).
