Supplemental Information Regarding Responsibility and Control Zion Nuclear Power Station, Units I and 2 Facility Operating License Nos. DPR-39 and DPR-48 NRC Docket Nos. 50-295 and 50-304
Reference:
January 25, 2008 letter from Exelon and ZionSolutions to NRC, "Application for License Transfers and Conforming Administrative License Amendments" This letter provides information in support of the Zion license transfer application contained in the letter referenced above. This clarifies that ZionSolutions, as the licensee for the site, will be responsible for and will have final decision-making authority over all licensed activities, even if other organizations (such as its parent company EnergySolutions and its affiliates) provide support services.
ZionSolutions, as the licensee for Zion Nuclear Power Station (ZNPS), will be responsible for and will: have ultimate control and final authority over all licensed activities, including decommissioning. As explained at page 7 of the January 25, 2008 license transfer application, ZionSolutions will be controlled by the management team set forth in an organization chart provided as Enclosure 2.
The application also',makes clear (page 7) that "[w]hen the proposed transfers become effective, [ZionSolutions] will assume responsibility for and control over the operation of the ZNPS:". In this context, the "operation" of ZNPS refers to the conduct of licensed activities,' including decommissioning.
It is anticipated that ZionSolutions will contract for decommissioning services from third party vendors, as well as from its parent EnergySolutions and its affiliates. In all such cases, ZionSolutions will oversee the activities of such contractors, and it will remain in control of all licensed activities at ZNPS.
ZionSolutions does not have any current plans to procure services under a management services agreement or other operating service contract of the type 101 Shiloh Boulevard

contemplated by NRC Regulatory Issue Summary 2001-06 dated February 15, 2001.
ZionSolutions will have its own project management organization, and in establishing this organization, it will draw upon existing site organization resources, new employees, and management resources from its parent company. For example, the Chief Executive Officer (CEO) of ZionSolutions, Steve Creamer, also serves as the CEO of EnergySolutions, and the President of ZionSolutions, John Christian, also serves as the President, Commercial Services of EnergySolutions. Having such senior managers participate in the management of the subsidiary (ZionSolutions) is not only common practice in the nuclear industry, but it is a very positive practice. This senior management involvement strengthens the management and operation of ZionSolutions and enhances the ability of ZionSolutions to conduct decommissioning and achieve its corporate goals. These executives will directly participate in the management of ZionSolutions and will report to the ZionSolutions Board. The Zion Restoration Project organization is described in further detail at pages 7-9 of the license transfer application.
