Dear Mr. Saporito:

Your letter dated July 5, 2008, and addressed to the Executive Director for Operations, U.S.

Nuclear Regulatory Commission (NRC), was referred to the Office of Nuclear Reactor Regulation pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.206, Requests for action under this subpart, of the Commissions regulations. You stated the following:

The undersigned Petitioner requests that the NRC take actions to immediately investigate apparent violations of 10 CFR 50.7 by the Licensee against Petitioner in refusing to rehire Petitioner solely because of his past, present, and continuing conduct in raising operational safety concerns to the NRC regarding the Licensees nuclear power operations.

As the basis for your requests, you stated that you have been raising operational concerns and that the licensee, Florida Power and Light Company, refuses to hire you.

In accordance with Management Directive 8.11, Review Process for 10 CFR 2.206 Petitions, your letter was referred to a Petition Review Board (PRB). The PRB met on July 17, 2008, and its initial recommendation was to not accept your letter for review in the 10 CFR 2.206 process.

In an email dated July 15, 2008, Tracy Orf, the petition manager, informed you of the NRCs receipt of your submittal. Your email dated July 15, 2008, requested the opportunity to speak with the PRB, and later, your email dated July 24, 2008, stated that you no longer wished to speak with the PRB and that you would be contacting the Office of the Inspector General of the NRC.

Our PRB reviewed your submittal in accordance with Management Directive 8.11. The NRC staff has concluded that your submittal does not meet the criteria for consideration under 10 CFR 2.206. Specifically, your submittal does not meet the following criterion:

The incoming correspondence does not ask for an enforcement-related action or fails to provide sufficient facts to support the petition but simply alleges wrongdoing, violations of NRC regulations, or existence of safety concerns.
