Dear Mr. Libra:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your June 25, 2008, letter requesting a fee waiver under 10 CFR 170.11(a)(1)(iii) for all fees associated with NRCs review of Boiling Water Reactors Vessel and Internals Project 182 (BWRVIP-182): BWR Vessel and Internals Project, Guidance for Demonstration of Steam Dryer Integrity for Power Uprate. Your request meets the fee waiver criteria; therefore, I am granting your request, as explained below.

Your fee waiver request states that BWRVIP-182 is a means of exchanging information to support NRCs generic regulatory improvements related to BWR power uprates and structural integrity of steam dryers. The NRC staff has reviewed your submittal and concluded that your topical report will provide a means of exchanging information to support NRCs generic regulatory improvements or effort. Specifically, upon approval of the topical report BWRVIP-182, licensees will be able to reference the topical report in their evaluations and corrective actions relating to both stress corrosion cracking and fatigue cracking caused by flow induced vibration at power uprate conditions, which have been experienced in a number of BWR steam dryers. The guidance in BWRVIP-182 serves as a means to address steam dryer degradation issues that are not addressed by the American Society of Mechanical Engineers Code or by NRC regulations. Hence, I am able to grant you a fee waiver under the provisions of 10 CFR 170.11(a)(1)(iii).
