MEMORANDUM AND ORDER (Denying Motion for Reconsideration of Portion of Advisory PAPO Boards June 20, 2008 Memorandum and Order)
The Nuclear Energy Institute (NEI) has moved for reconsideration, pursuant to 10 C.F.R.
§ 2.323(e), of a portion of the Advisory Pre-License Application Presiding Officer Board (Board)s June 20, 2008 Case Management Order (Order). According to NEI, the Order suggests1 - or appear[s] to contemplate2 - that potential parties in addition to the Department of Energy and the NRC Staff may be allowed to file answers to contentions in violation of the Commissions regulations. NEI sees clear and material error.3 NEI reads the Boards Order incorrectly. The Commission did not empower the Board to 1

address the standing or capacity of any entity to file any document,4 and the Board did not do so. The Boards Order addressed formatting issues. Whether any party or potential party may file any particular document, consistent with the Commissions regulations, would appropriately be raised with the boards that may be constituted to consider petitions to intervene in any high-level waste repository construction authorization proceeding.
NEIs motion for reconsideration is denied.
