NEW ENGLAND COALITION, INC's MOTION TO STRIKE NRC STAFF REBUTTAL TESTIMONY CONCERNING NEC CONTENTION 4 Pursuant to 10 CFR § 2.323 and the Initial Scheduling Order ¶ 10, New England Coalition, Inc. (NEC) moves to strike the NRC Staff Rebuttal Testimony of Kaihwa R.
Hsu Concerning NEC Contention 4 and Exhibits A-C thereto, filed June 2, 2008. The NRC Staff previously filed the direct testimony of Mr. Hsu in support of the Staff s Initial Statement of Position. See, Affidavit of Kaihwa R. Hsu and Jonathan G. Rowley Concerning NEC Contention 4 (Flow-Accelerated Corrosion) (May 13, 2008). Mr. Hsu's "rebuttal" testimony exclusively contains information and argument in response to NEC's Initial Statement of Position and direct testimony that could and should have been included in his direct testimony. Hsu Concerning NEC Contention 4 (June 2, 2008) at A2 ("The purpose of this rebuttal testimony is to address the pre-filed written testimony and exhibits of Dr. Hausler, Mr.

Witte, and Dr. Hopenfeld regarding New England Coalition, Inc.'s ("NEC") Contention XN 4, which were submitted on behalf of NEC on April 28, 2008.").
The Initial Scheduling Order in this proceeding provided for a staggered filing of Initial Statements of Position and direct testimony and exhibits. Initial Scheduling Order (November 17, 2006) at ¶¶ 10(A),10(B) and 10(C). NEC filed first, on April 28, 2008.
Entergy and the NRC Staff filed Initial Statements of Position, direct testimony and exhibits in response to NEC's Initial Statement, direct testimony and exhibits two weeks later, on May 13, 2008. All parties were then permitted to file Rebuttal Statements of Position, and rebuttal testimony and exhibits on June 2, 2008. Id. at ¶ 10(D).
In light of the staggered filing of Initial Statements of Position, the Initial Scheduling Order ¶ 10(D) is most reasonably interpreted to allow the NRC Staff to file rebuttal testimony responsive only to Entergy's Initial Statement of Position and direct testimony. The NRC Staff should not be permitted to file "rebuttal" testimony that essentially constitutes a late-filed addendum to its direct testimony in response to NEC's initial Statement of Position.
Entergy's rebuttal testimony reflects this interpretation of the Initial Scheduling Order: Entergy's rebuttal addresses only the NRC Staff's Initial Statement of Position and direct testimony. See, Joint Supplemental Declaration of James C. Fitzpatrick and Gary L. Stevens on NEC Contentions 2A/2B - Environmentally Assisted Fatigue (May 30, 2008) at A7 ("The purpose of our supplemental testimony is to respond, on behalf of Entergy, to certain materials submitted by the NRC Staff ("Staff") regarding NEC Contentions 2A/2B in this proceeding.").

The NRC Staff Rebuttal Testimony. of Kaihwa R. Hsu Concerning NEC Contention 4 (June 2, 2008) is outside the proper scope of rebuttal testimony under,Initial Scheduling Order ¶ 10. The Board should strike it from the record.
NEC has consulted or attempted to consult with all parties regarding this motion.
Entergyis opposed. The NRC Staff and the State of Vermont will respond once they review NEC's filing. The States of Massachusetts and New Hampshire did not take a position.
