CONFIRMATORY ORDER (EFFECTIVE IMMEDIATELY)
This is to inform the Commission that a Confirmatory Order confirming commitments reached as part of an alternative dispute resolution (ADR) mediation settlement agreement will be issued on or about June 13, 2008, to the Florida Power and Light Company (FPL or Licensee) regarding a low level supervisor at the St. Lucie Nuclear Plant who willfully failed to take action to identify two contract workers as untrustworthy subsequent to their actions to falsify a work order related to maintenance activities they performed. In response to our letter, which documented two apparent violations of FPL procedures, FPL requested ADR.
A settlement agreement was reached at an ADR mediation session conducted on May 16, 2008. Both parties agreed, among other things, that: (1) a violation occurred involving FPLs failure to adhere to FPL Nuclear Division Policy; (2) the condition report (CR) written in response to the incident, did not fully document the circumstances of the issue to permit FPL to conduct a thorough review such that corrective actions and a trustworthiness and reliability assessment would be performed; (3) FPL reiterated its commitment to conduct trustworthiness and reliability assessments as required, and agreed to implement or has completed extensive corrective actions, training and enhancements in response to the violations; (4) in consideration of the commitments by FPL, the NRC agreed to exercise enforcement discretion and forego issuing an NOV or other enforcement action against FPL.
