SURRY POWER STATION UNITS 1 AND 2 NORTH ANNA POWER STATION UNITS 1 AND 2 MILLSTONE POWER STATION UNITS 1, 2 AND 3 KEWAUNEE POWER STATION DECOMMISSIONING TRUSTS: TRUSTEE REORGANIZATION Conditions in the licenses for Millstone Power Station Units 1, 2 and 3 provide that the nuclear decommissioning trust aqreernents for these units cannot be amended in any material respect without 30 days prior written notification to the Director, Office of Nuclear Reactor Regulation. 10 CFR 50.75(h)(1)(iii) contains a similar requirement applicable to the Kewaunee Power Station.
Dominion Nuclear Connecticut, Inc. (DNC) and Dominion Energy Kewaunee, Inc. (DEK) have been notified by Mellon Bank, I\\I.A., trustee of the nuclear decommissioning trusts for these units, that Mellon Financial Corporation has merged with the Bank of New York Company. In connection with this merger, Mellon's various banking entities are being reorganized, with The Bank of New York Mellon becoming, by operation of law, the successor entity to Mellon Bank, N.A., on or about July 1, 2008.
While DNC and DEK do not consider this successorship to constitute a material amendment to the nuclear decommissioning trusts, we are providing this notification to ensure that the NRC is aware of this change.
In addition, this successorship applies to the decommissioning trust funds for Virginia Electric and Power Company's Surry and North Anna Power Stations.
