Dear Mr. R. William Borchardt:
Loss Prevention, or Hedging a Bet I thought I would take the time now to point out some steps that may make your life a little easier in the future. Your agency is not getting along too well with one of our Senators. As you know, she is running for President. If she does become President, taking these steps, starting now, may be beneficial.
Step 1 The required-by-law backup power emergency sirens at Entergy/Indian Point are still not accepted as operable. Very substantial immediate enforcement type action is needed here.
Step 2 The unloading of the Entergy/Indian Point Unit 1 spent fuel pool has not begun but the contaminated water leakage into the ground continues. Take action here.
Step 3 The report of the contaminated groundwater at the Entergy/Indian Point site has been completed. (I read it and the work reported appeared quite thorough.) There are two recommendations: leave the contaminated groundwater in place using a terminology of "Monitored Natural Attenuation" (which, I think, means decay in place), and stop the source of the contaminated water. I have not seen any document in ADAMS that states that all Entergy ownership organizations agree to follow the recommendations. Find out why not.
Step 4 More generally, consider as a part of relicensing, plant owner decisions and results attained. Specifically, if Entergy Corporation and 7 lower tier ownership organizations cannot complete a $15 million project one year AFTER the required date, should you really allow them 20 more years? (The 7 are: Entergy Nuclear Holding Company, EN Holding Co #3 LLC, EN Inv. Co. LLC, Entergy International Holdings LTD, Entergy Global LLC, Entergy Nuclear Holding Company #1, and EN New York Inv. Co). Oh, don't forget 2 more: EN Indian Point 2 LLC and EN Indian Point 3 LLC.
And, probably there are even more for Unit 1.

Step 5 Make clear to all US NRC employees that your primary mission is to ensure the safe power operation (or safe cold shutdown) of the existing plants, NOT promote high capacity factors or nuclear industry growth.
Your staff may notice that this letter, dated March 13, 2008, was sent already. I am sending it again since it has not been answered. This way, it will not get lost in the upper management turnover. Please note that, with the possible exception of Step 3, these points are still valid two months later.
