INDIAN POINT NUCLEAR GENERATING UNIT NOS. 2 AND 3 - WITHDRAWAL OF AN AMENDMENT REQUEST REGARDING FIRE PROTECTION LICENSE CONDITIONS (TAC NOS. MD4921 AND MD4922)
Dear Sir or Madam:
By letter dated March 13, 2007, you applied for an amendment to the Indian Point Nuclear Generating Unit Nos. 2 and 3 Facility Operating Licenses Nos. DPR-26 and DPR-64, respectively. The proposed change would have revised the fire protection license conditions by removing the listing of dated Fire Protection Safety Evaluation Reports (SERs) within the facility licenses. Subsequently, by letter dated May 6, 2008, you withdrew the amendment request.
Accordingly, the list of SERs will remain in the fire protection license conditions. Further, the NRC staff concurs with your view that exemption approval dates do not have to be added to the fire protection license conditions.
The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

DOCKET NOS. 50-247 AND 50-286 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENT TO FACILITY OPERATING LICENSE NOS. DPR-26 AND DPR-64 INDIAN POINT NUCLEAR GENERATING UNIT NOS. 2 AND 3 The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of Entergy Nuclear Operations, Inc. (the licensee) to withdraw its March 13, 2007, application for proposed amendments to Facility Operating License No. DPR-26 for Indian Point Nuclear Generating Unit No. 2 and Facility Operating License No. DPR-64 for Indian Point Nuclear Generating Unit No. 3, located in Westchester County, New York.
The proposed amendments would have revised the fire protection license conditions by removing the listing of dated Fire Protection Safety Evaluation Reports (SERs) contained within the licenses.
The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the Federal Register on April 10, 2007 (72 FR 17947). However, by letter dated May 6, 2008, the licensee withdrew the proposed change.
For further details with respect to this action, see the application for amendment dated March 13, 2007, and the licensee's letter dated May 6, 2008, which withdrew the application for a license amendment.
