Irqq UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 May 13, 2008 Mr. J. Randy Johnson Vice President - Farley Joseph M. Farley Nuclear Plant 7388 North State Highway 95 Columbia, AL 36319

SUBJECT:

SUMMARY

OF DAM SAFETY INSPECTION FOR THE COOLING WATER STORAGE DAM AT THE JOSEPH M. FARLEY POWER STATION, UNIT NOS. 1 AND 2

Dear Mr. Johnson:

On July 10, 2007, a routine safety inspection was conducted at Alabama Power Company's Joseph M. Farley Power Station, Unit Nos. 1 and 2, Cooling Water storage pond. The staff of the U.S. Nuclear Regulatory Commission (NRC) has received and evaluated the final report from its technical assistance contractor, the Federal Energy Regulatory Commission (FERC),

related to this inspection. The inspection did not identify any conditions that represent a threat to the safety or the operation of the Service Water Reservoir.

The NRC staff concurs with the recommendations made in the FERC report (Enclosure).

Several items were identified and should be addressed by Alabama Power Company. These are: 1) Pieziometer, observation well and survey data presentation; 2) The pieziometer and observation well acceptance criteria should be reviewed to ensure it reflects safe conditions for performance of the dam.

The information in the report is considered critical energy infrastructure information. Thus, the enclosure is considered sensitive security-related information, official use only, and is marked accordingly.

The enclosure transmitted herewith contains security-related information.

When separated from the enclosure, this document is decontrolled.

The enclosure is designated as "non-public" and is not accessible by the public for review. If you have any questions regarding this matter, please feel free to contact me at (301) 415-2728.
