FIRST QUARTER 2008 ASSESSMENT LETTER - JOSEPH M. FARLEY NUCLEAR PLANT

Dear Mr. Johnson:

On May 5, 2008, the NRC staff completed a review of the performance of the Joseph M. Farley Nuclear Plant for the twelve month period prior to March 31, 2008. The assessment included an evaluation of the performance indicators (PIs) at Farley, as well as findings from our inspections. The purpose of this letter is to inform you of the results of our assessment of your safety performance during this period and our plans for future inspections at your facility. This letter supplements, but does not supersede, our annual assessment letter dated March 3, 2008, which confirmed that Farley Units 1 and 2 were in the Degraded Cornerstone column of the NRC=s Action Matrix since the third quarter of 2007.

Our assessment of your performance recognized that for the first quarter of 2008, the Green-to-White threshold for the Unit 1 Emergency AC Power System Mitigating System Performance Index (MSPI) was exceeded. The White threshold was exceeded for this MSPI primarily due to your reporting two independent run failures of the 1B emergency diesel generator (EDG). As a result of our review, we assessed that Farleys performance for both units remained in the Degraded Cornerstone column of the NRC=s Action Matrix for the first quarter of 2008. As indicated in our annual assessment letter, the NRC will conduct a 95002 supplemental inspection in accordance with the NRCs Reactor Oversight Process (ROP). This inspection is scheduled for June 2 through June 13, 2008.

In addition, our quarterly review recognized that the additional White Emergency AC Power System MSPI, when combined with the existing White MSPI for Cooling Water Systems, may cause Unit 1 to remain in the degraded cornerstone column of the NRC=s Action Matrix for five or more consecutive quarters. If this were to occur, Unit 1 would transition to the Multiple/

Repetitive Degraded Cornerstone column of the NRC=s Action Matrix in the third quarter of

2008. When we conduct our mid-cycle assessment of Farleys performance in August 2008, we will consider the results of the upcoming 95002 supplemental inspection, the impact of any other greater-than-green PIs and/or findings, as well as Farleys position in the Action Matrix to determine the need to plan for further supplemental inspection.

In accordance with 10 CFR 2.390 of the NRC=s ARules of Practice,@ a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
