NRC ACKNOWLEDGMENT OF BYRON STATION RESPONSE TO FINAL SIGNIFICANCE DETERMINATION LETTER DATED APRIL 1, 2008, FOR A WHITE FINDING AND NOTICE OF VIOLATION NRC INSPECTION REPORT 05000454/2007009(DRS); 05000455/2007009(DRS)

Dear Mr. Pardee:

The Nuclear Regulatory Commission (NRC) acknowledges the receipt of your letter dated May 1, 2008, in response to our letter dated April 1, 2008, transmitting a Notice of Violation associated with Inspection Report Nos. 05000454/2007009(DRS); 05000455/2007009(DRS).

This report summarized the results of the NRCs Special Inspection at the Byron Station and documented a White finding associated with the degradation of the essential service water (SX) system riser piping at the cooling tower basin.

In your letter, you acknowledged the violations regarding: (1) the failure to take prompt corrective actions for conditions adverse to quality (degraded SX riser pipes); and (2) failure to adequately verify the design of the degraded SX piping. You indicated that the cause of the violations was inadequate procedural guidance related to trending, tracking, identification threshold, and follow-up action for safety-related external pipe corrosion. Additionally, you identified that individuals failed to accurately characterize the level of degradation due to a lack of sensitivity to allowable design margins on the piping. Your letter also provided information about enhancements to procedures and programs, and personnel training that either have been made or will be taken to preclude the reoccurrence of the violations.

The NRC is currently reviewing your response. After our review is completed, we will use the response to determine the scope of the Supplemental Inspection 95001, Inspection for One or Two White Inputs in a Strategic Performance Area, as described in our Assessment Follow-up Letter dated May 6, 2008. Please notify Richard Skokowski at 630-829-9620 once you have completed your root cause analysis and when you are ready for our supplemental inspection to occur.
