On May 6, 2008, the Commonwealth of Massachusetts filed a notice of intent to participate in this proceeding as an interested State pursuant to 10 C.F.R. § 2.315(c).1 The Commonwealth seeks to participate in this proceeding to ensure that the issues raised in the Commonwealths single contention will be resolved before the NRC issues any renewed operating license herein. Notice at 1. The Notice is based on the recent decision in Massachusetts v. United States, 522 F.3d 115 (1st Cir. 2008).
2 The requirement that a State designate a single representative avoids entangling NRC in confusion that may arise when multiple agencies seek to represent a State, and assures that each State speaks with a single authorized voice in NRC adjudicatory proceedings. It involves the designation of a single officer or individual who is the States decision-maker. Notice of appearance by counsel under 10 C.F.R. § 2.314 does not satisfy the requirement that a State designate a single representative under 10 C.F.R. § 2.315(c).
3 Copies of this order were sent this date by Internet e-mail transmission to counsel for (1) licensees Entergy Nuclear Vermont Yankee, L.L.C., and Entergy Nuclear Operations, Inc.;
(2) intervenors Vermont Department of Public Service and New England Coalition of Brattleboro, Vermont; (3) the Staff; (4) the State of New Hampshire; and (5) the Commonwealth of Massachusetts.
The Board grants the Commonwealths request, provided it files, within thirty days, a designation of its single representative as required by 10 C.F.R. § 2.315(c).2 Thereafter, the representative of the Commonwealth shall be permitted to participate, as specified in 42 U.S.C.
§ 2021(l) and 10 C.F.R. § 2.315(c).
It is so ORDERED.
